The battle of Waterloo is universally associated with the last stand of Napoleon. It is (for all intents and purposes) the most significant blow to Napoleons final attempt at a return to power, Napoleons loss sealed his fate and consequently lost his empire (once and for all). However was it truly Napoleon’s faults that resulted in the loss at Waterloo? Question: Discuss about theAustralian Consumer Law for Consumers Right. Answer: Issues There was a contractual invitation given by Nikhils Car Sales Pty Limited to Vanessa. The price of the car is $9,900. Vanessa agrees to buy it for $9,500 in cash. In the office a sale document is prepared and a copy of the cash sales at $9,500 is given to Vanessa. There was a written contract between Nikhil and Vanessa and Nikhil did not give the warranty card when Vanessa bought the car. Contract without warranty is made so there is obligation on the part of Nikhil as to whether there is a violation in the contract and if Nikhil is breaching the rules of consumer rights act in the given case (Griggs, 2011). The problem arises because warranty card was not delivered by Nikhil to Vanessa. The contract has problem because all the elements were properly not discovered here. The questions arise: Is the contract has made properly? Will argument rise against this case? Law The contract can be cancelled if there are unfair terms and the court can declare the case unconscionable. If there is an imbalance in the right of the party which arises under the contract, the court declares the contract as unfair or unconscionable. It is not necessary for a party to protect the legitimate interests of the party which would be advantaged by the term. There would be a detriment to a party if it relies on the contract. The Australian Consumer Law guarantees that the seller can sell the goods only if the goods are of acceptable quality and match their description and fit the purpose of the consumer (Radan, et al. 2009). The services should be handled with reasonable skill and care and the services are completed within a reasonable time of no agreed date. Here as per contract law of Australia, the contract rules are not fulfilled and the warranty is not provided to Vanessa by Nikhil which is violation of rules of an agreement. For example the case like Oscar Chess Ltd v Williams Case is similar to this case where the owner of the second hand car tends to sell the car stating that it is a model of 1948. The contract took place between the dealer and the seller but the dealer became aware that the car is a model of 1939. The dealer sued the seller but under law, it was the fault of the dealer because he did not check the condition of the car. The case is similar to the case of Nikhil and Vanessa to an extent due to the victim being mislead because of their carelessness and it is not enforceable in both these cases. Lack of legal consideration and presence of elements of the contract showed that the contract is not enforceable. Application The Australian Consumer Law includes that the seller should make sure the lay of agreement is in the writing. The Australian Consumer Law states that a consumer may terminate a lay-by agreement at any time before the goods are delivered and the seller should not terminate the agreement except certain circumstances. There is lack of presence in the elements, conditions which are misleading done by the seller while he sells the car to Lara. There is an offer, legal intention, and acceptance after a contractual invitation but consideration and warranty, terms and conditions is not present so the contract is not enforceable under law (Latimer, 2012). According to part 5 of Trade Practices act 1974, commercial trade processes are not followed by Nikhil which is the breach of Fair Works Act. According to the Trade Practice Act the rules of commercial programs and the methods to sell the car by providing proper rudiments are not given by Vanessa and Nikhil. Under the Consumer Rights Act, Vanessa can sue Nikhil (Steinwall, et al. 2010). Conclusions There is a violation of the rules of the Consumer Competition Act, Contract Act and Trade practice Act of Australia as the seller has not maintained the rules of the contract and for the reason the contract is not enforceable under the law. Issues An invitation of treat is given by Nikhils car sales Pty Ltd and features of the 3 model Mazda is described whose price is $9,999. The offer was counter offered by Vanessa and the price fixed at $9,500. A sale agreement was made between both the parties. Issue arises because the warranty card is not delivered to Vanessa. For that reason the contract is not enforceable. All the elements such as offer, acceptance and invitation of treat are mentioned but the terms and warranty of the contract is not mentioned here. The car is second hand, so after three months the car was slipping out of the gear when she gave it for servicing the automatic clutch of Mazda 2 was in bad condition. What are the methods through which Vanessa can sue Nikhil for misrepresenting her? Conclusion The rights of the common law is stated her through which the plaintiff can claim for compensation from the defendant and as per courts order the remedy has to be given by Nikhil to Vanessa. Issues Sales agreement took place between Nikhil and Vanessa but obligation arises as the warranty card or guaranty is not provided. Even the breach of contract law and consumer law has done. Problem arises because the car got damaged after 3 months and Vanessa has to suffer for that. The question arises: What punishment should be awarded to the defendant? As per which act the plaintiff can ask for the rights from the defendant? Laws According to the Australian Consumer Law, it is prohibited to mislead the buyer and unlawful in making statements in the trade of commerce which can mislead the buyer. If the seller fails to disclose relevant information, it can also mislead the buyer. Under Australian Consumer Law, sellers should compensate for the buyer due to the loss of damage suffered due to supply of goods with a safety defect. Actions could also be brought upon by enforcement agencies on behalf of the affected buyer (Ramsay, 2012). Product Safety Law refers to product related services in the Australia. The Australian Consumer Law outlines the responsibilities of the sellers under the national product safety framework. Vanessa should follow the rules of Consumer Rights Act (Ellinghaus, 2007). According to Consumer Protection Act and Consumer Rights Act the consumer can claim monetary compensation from the seller for misleading or doing misrepresentation with her. As per section 18 of Consumer rights act with the legal notification of chapter 3 the car sold b y Nikhil is unsolicited good and for doing misrepresentation with Vanessa, he has to give monetary damage to Vanessa. How Dragonflies Males Find and Mate with Females Dragonfly sex is a rough-and-tumble affair. If youve ever seen a pair of mating dragonflies in the act, you know that their sexual coupling requires the flexibility and acrobatic skill of a Cirque de Soleil performer. Females get bitten, males get scratched, and sperm winds up everywhere. These strange mating habits have survived millions of years of evolution, so the dragonflies must know what theyre doing, right? Lets take a closer look at how dragonflies mate. How Dragonfly Males Find Receptive  Females Dragonflies dont engage in elaborate courtship rituals. In a few dragonfly families, the male might display his colors or fly over his territory to show a potential mate what a good oviposition site hes chosen for their offspring, but thats about it. Since dragonflies have extraordinarily good vision, the males rely mostly on their eyesight to find appropriate female partners. A typical pond or lake habitat will support many species of dragonflies and damselflies. To succeed in passing on his DNA, a male dragonfly must be able to distinguish females of his own species from all the other Odonates flying around. He can recognize a conspecific female by observing her flight style, her colors and patterns, and her size. How Dragonflies Mate (and the Wheel Formation) As with many insects, male dragonflies make the first move to initiate sex. When a male spots a female of his own species, he must first subdue her. Hell approach her from behind, usually while they are both in flight, and hold onto her thorax with his legs. He might bite her, too. If he hopes to mate successfully, he must get a firm  grip on her quickly. He pulls his abdomen forward and uses his anal appendages, a pair of cerci, to clasp her by the neck (her prothorax). After he has her tightly by the neck, he extends his body and continues to fly with her, in tandem. This position is known as tandem linkage. Now that hes got a hold of a mate, the male dragonfly prepares for sex. Dragonflies have secondary sex organs, meaning they dont store sperm near the copulatory organ. He must transfer some sperm from a gonopore, on his ninth abdominal segment, to his penis, which is located under his second abdominal segment. After hes charged his seminal vesicle with sperm, hes ready to go. Now for the acrobatics. Somewhat inconveniently, the females genital opening is near her thorax, while the males penis is closer to the tip of his abdominal segments (on the underside of his second segment). She has to bend her abdomen forward, sometimes with coaxing from the male, to bring her genitalia into contact with his penis. This position during copulation is known as a wheel formation because the couple forms a closed circle with their joined bodies; it is unique to the order Odonata. In dragonflies, the sex organs lock together briefly (not so for damselflies). Some dragonflies will mate in flight, while others will retire to a nearby perch to consummate their relationship. Competition Among Male Dragonflies If given the opportunity, a female dragonfly might mate with multiple partners, but the sperm from her final sexual partner will fertilize her eggs, in most cases. Male dragonflies, therefore, have an incentive to make sure their sperm is the last to be deposited in her. A male dragonfly can increase his chances of fatherhood by destroying the sperm of his competitors, and hes well equipped to do so when he mates. Some dragonflies have backward-facing hooks or barbs on their penises, which they can use to scoop out any sperm they find inside their partner before depositing their own. Other dragonflies use their penises to tamp down or move the offending sperm, pushing it aside before he places his own in the ideal location for fertilization. Still, other dragonfly males will dilute any existing sperm they find. In all cases, his goal is to ensure that his sperm supersedes that of any prior partners she has had. Just to provide an added measure of security for his sperm, the male dragonfly will often guard the female until she oviposits her eggs. He tries to prevent her from mating with any other males, so his sperm is assured the last in position that will make him a father. Male damselflies will often continue to grasp their partners with their cerci, refusing to let go until she oviposits. Hell even endure a dunking in the pond if she submerges to place her eggs. The Abolitionist, or those who wanted to abolish slavery, believed that slavery violated many rights and beliefs held by the American nation. They argued that capturing others and forcing them into labor was a direct violation of the constitutions inalienable rights: life, liberty, and the pursuit of happiness. Even though at the time we were plagued with extreme racism against blacks (some to the extent of believing that blacks were of a sub-human species), the abolitionist argued that everyone should be given the opportunity to have these rights, regardless of race. They strengthened this point by using scriptures directly taken from the Christian bible. Scriptures such as Matt 7:12 do to others what you would have them do to you,backed up their point that capturing others for forced labor was morally wrong. Other scripture such as Col 4:1 Masters, grant to your slaves justice and fairness, knowing that you too have a Master in heaven, aided their next major argument against slavery; the treatment of slaves. Many slave holders, or to the slaves, masters, were brutal in the treatment of their laborers. Cruel forms of punishment were used against those slaves who were rebellious or did not work to their masters standards, but rarely did a slave holder kill their slaves. At up to $2000, the were much too valuable property to simply kill. This treatment outraged the abolitionist, and the debate raged on. The slave holders of the south presented many valid arguments. The southern states stated that abolishing slavery would be devastating to the economy of  America. Three of the nations largest crops, cotton, tobacco, and rice, were profitable only because of slave labor. Such a large amount of workers were needed, that slavery was one of their only options that would not cost more than the money they made from their cash crops themselves. Slavery was cheaper because the slaves worked consistently, as opposed to laborers of the north who were in constant competion of each other, and in and out of work. If slavery were to be outlawed, these crops would eventually fail, causing an economic turmoil in the nation. Profits made from trading with other counties would plummet and, the north would also be greatly affected because the only way many of the industrial workers in the north could afford clothing was to wear those made of the cotton imported from the south. This led to their next point against abolitionist. Wage Slavery. Although abolitionist believed the north was giving their civilians their freedom rights, the only choice for most of the northern laborers was to work or starve. Many parents were forced to sell their children into contracts with companies as soon as they were old enough to work (5-6 yrs. old by northern standards), just so they could help their families survive. The south argued that working conditions for children laborers in the north were worse than their slaves of the south, and at wages of just cents a day, and no guarantee of food, shelter, or clothes, the slaves were virtually living in a paradise. The slave holders also used the bible to their advantage, much like the north. Verses such as Col 3:22 Slaves, in all things obey those who are your masters on earth, not with external service, as those who merely please men, but with sincerity of heart, fearing the Lord., not only strengthened the souths case morally but it was also useful in keeping their slaves in line during sermons when they were christianizing them. The most prominent point though, was that slavery, was legal. Both the north and the south contributed many viable points, but in the end, slavery was abolished. Its final days ended when Abraham Lincoln signed the Emancipation Proclamation, freeing all of the enslaved blacks of the south. Even though the north won, I believe the answer to this debate over slavery lays somewhere between both arguments. All great societies throughout  history have been built largely on slavery, but the oppressing of a people for racial reasons is what I believe to be morally wrong. Whether strong-willed opinions or compromise wins out is always up to us as a democratic nation.
